When Workplace Bullying Becomes the Employer’s Problem

On the 1st of September 2026, Botswana entered a new employment law era with the commencement of the Employment and Labour Relations Act, 2025 (The Act). The legislation replaces the previous Employment Act and introduces a broader framework governing employment standards.

It is expected that much of the immediate attention will fall on the HR department because employment legislation is often treated as an HR matter. HR will be expected to review employment contracts, and disciplinary procedures and grievance processes. While all this is necessary, it is important not to overlook the role of the board in ensuring that these measures actually work within the organisation.
