By Olayiwola Balogun – Migrants will no longer be granted the right to live in the UK forever almost automatically after five years, under a new Earned Settlement model laid before Parliament on Monday 2 November 2026.
The Government says settled status is a significant privilege that gives unrestricted access to the labour market, NHS and welfare system. Under the reforms, how long someone waits to settle will depend on their contribution and character.
New settlement timelines:
• 3 years: Highest earners
• 5 years: Those earning over £50,271 and key public service workers such as doctors, nurses and teachers
• 10 years: New default for most other migrants
• 20+ years: Those who have breached immigration rules
All applicants, regardless of when they arrived, must meet four non-negotiable conditions: a spotless criminal record (tightened from the current 12-month suspended sentence threshold), English spoken to a high standard equivalent to A-Level English as a foreign language, no debt owed to the taxpayer, and a record of sustained National Insurance contributions.
New deal for care workers
The reforms largely follow the November 2025 consultation, but include a new fair deal for care workers. In recognition of their contribution during the COVID-19 pandemic, care workers who met their visa conditions and earned at least £25,000 a year will be able to settle after five years.
Ministers said the route was also abused by rogue companies sponsoring workers for non-existent jobs. Under this Government, 1,800 exploitative employers have been stripped of their right to sponsor foreign workers.
Those who do not qualify for five-year settlement – around a quarter – will be offered a second chance through a new five-year visa, with settlement possible only after completion. A similar approach will apply to healthcare and education workers who arrived during the same period.
An estimated 500,000+ people will now wait longer than five years to settle, a move the Government says will save billions on the welfare bill. No one will be forced to leave, and everyone will have a fair chance to apply for visas allowing settlement after 10 years.
Prime Minister Andy Burnham said: “People want to see an immigration system based on control, contribution, and which rewards those who play by the rules. Following Brexit, the previous government lost control of immigration, with an unprecedented spike in numbers. This Home Secretary is gripping this problem, and she has my full support in doing so.”
Home Secretary Shabana Mahmood said: “Settled status is one of the most valuable rights this country can offer. Until now it has been given almost automatically. From today, it must be earned. Those who contribute most will settle fastest. Those who don’t play by the rules will be refused or wait much longer.”
Refugee settlement
The policy also sets new rules for refugees to encourage safe, legal routes and deter small boat crossings. Refugees on Home Office-approved routes can settle after five years. Others will wait 20 years, reduced to 10 if they work or study. Those who arrived by small boat or other clandestine means face an additional 10-year wait – up to 30 years in total.
Settled status will not be removed from anyone who already holds it. Family members of British citizens, Hong Kong British Nationals (Overseas) and members of the armed forces will keep their current pathways.
The Government said the UK will also have the most business-friendly migration system in Europe for highly skilled workers.
