A motion seeking parliamentary endorsement of Gerson Sindano as chairperson of the Electoral Commission of Namibia (ECN) has been postponed following strong objections from Affirmative Repositioning leader Job Amupanda.
The motion, which was first on Tuesday’s order paper, sought approval for president Netumbo Nandi-Ndaitwah to appoint Sindano as ECN chairperson alongside commissioners Emmerentia Leonard and Julieta Ferreira.
Amupanda says he has nothing against Sindano personally but argues that the nomination does not comply with the Constitution and the Electoral Act.
“It has been postponed. We hope they rectify the mistakes and that the president is advised correctly for the sake of national interest. We want those records, score sheets and recommendations from the president, ” he says.
Amupanda says Sindano’s current term as an ECN commissioner expires on 21 June 2027, creating a legal conflict because the ECN chairperson must be appointed from among the five commissioners and serve a five-year term.
He argues that Sindano would first have to complete his term as commissioner before assuming the chairperson position, as the law requires a full five-year tenure for the office.
Amupanda further maintains that the chairperson position should have been publicly advertised and subjected to an interview process, which he says was not followed.
“As it is now, we have nothing against him. But Gerson Sindano does not qualify in terms of the Constitution and the Electoral Act. We will not rubber stamp. We will challenge this. If this is how they are operating, it raises concerns about how they are handling the law,” he says.
The postponement has placed the proposed appointment under fresh scrutiny, with questions now being raised over whether the nomination process complied with the country’s legal requirements.
