*Consumers who purchased toothpaste from Tom’s of Maine in recent years may be entitled to compensation as part of a proposed $2.9 million class-action settlement. Eligibility covers a broad window of purchases, and even those without receipts could still receive a payment.
According to KTLA, the settlement applies to anyone who bought the brand’s toothpaste between November 21, 2020, and March 6, 2026. Unlike many similar cases, all toothpaste varieties are included, with no restrictions tied to specific product lines. Claims can be submitted either online or by mail, and payments may be issued through digital platforms or by check.
How much an individual receives depends largely on documentation. Those who can provide proof of purchase may be reimbursed for up to three items, while those without records can still claim an amount based on the average retail price of a single product. If the number of approved claims surpasses the available funds, payouts could be reduced proportionally.
The agreement stems from a lawsuit filed in December 2025 against Colgate-Palmolive Company, the brand’s parent company. The legal action followed a 2024 inspection by the U.S. Food and Drug Administration that identified manufacturing issues at a facility in Maine.
During that inspection, officials documented a “black mold-like substance” in parts of the production area and noted “powder residues” near a batch of children’s toothpaste. Despite those findings, company testing later determined that thousands of toothpaste units produced over a three-year span did not present a safety risk.
Even so, the complaint accused the company of “deceptive and misleading business practices with respect to the manufacturing, marketing, and sale of Tom’s toothpaste.” While the allegations have been denied, the company agreed to settle the case.
Any remaining funds after claims are paid will be directed to Equal Justice Works. The deadline to submit a claim is July 6, 2026, and final approval is scheduled for a court hearing on September 10, 2026. Payments will only be distributed after that process concludes and could take longer if appeals are filed.
