Delta family court strikes out ‘fabricated’ case against three children

A Family Court sitting in Ughelli Community, Ughelli North Local Government Area of Delta State, has struck out a fabricated case against three children of the same parents who were arrested by the police. The court struck out the case on Friday, May 14, DAILY POST learnt.

A former Chairman of the Committee for the Defence of Human Rights (CDHR), Comrade (Elder) Amrevuahwo Edariese, disclosed this to our correspondent in Warri on Sunday.

He said the court struck out the case against the three children, who are within the ages of twelve (12) and seven (7) respectively, because the case was “fabricated”, pointing out that the police, who brought the case before the court without a petition written by anyone, just “cooked up the story” and alleged the children to be cultists.

According to him, neither the police nor any complainant showed up in court when the case was mentioned. He noted that the case was transferred from the Magistrate Court sitting in Orhuwhorhun Magisterial District in Udu Local Government Area to the Family Court sitting in Ughelli Judicial Division.

It was learnt that the police had earlier, in a case between the Commissioner of Police and the three children, namely Senior Sargin ‘M’, aged 12 years, Believe Sargin ‘M’, aged 12 years, and Precious Sargin ‘F’, aged 7 years, in Charge No. MCOR/2C/2026, arraigned them before a Magistrate Court presided over by His Worship O.A. Dedekuma (Mrs.), Senior Magistrate Grade II, on a three-count charge on Friday, January 16, 2026.

Upon the charge dated January 16, 2026, brought before the court, it read:

“That you, Senior Mobor Sargin ‘M’, Believe Sargin ‘M’ and Precious Sargin ‘F’, sometime in the month of November 2025 at Orhuwhorhun Road, by Waterside Junction in the Orhuwhorhun Magisterial District, did conspire among yourselves to break and enter into a store belonging to one Joy Oreva Egbeka ‘F’ with intent to commit felony therein and thereby committed an offence punishable under Section 516 of the Criminal Code Law, Cap C21 Vol. 1, Laws of Delta State of Nigeria, 2026.

“Count II: That you, Senior Sargin ‘M’, Believe Sargin ‘M’ and Precious Sargin ‘F’, on the same date and place in the aforementioned Magisterial District, having broken into the store of Joy Oreva ‘F’ to commit felony, broke out and thereby committed an offence punishable under Section 411(1)(2) of the Criminal Code Law, Cap C21 Vol. 1, Laws of Delta State of Nigeria, 2026.

“Count III: That you, Senior Sargin ‘M’, Believe Sargin ‘M’ and Precious Sargin ‘F’ did steal 13 pieces of super packs of Indomie valued at N15,000, fried groundnut valued at N8,000, five Hollandia yoghurts valued at N12,500, fried meat valued at N25,000, 11 pieces of plastic valued at N5,500, 13 pieces of Hungry Man Indomie valued at N9,100 and a cash sum of N150,000, totalling N215,950, property of one Joy Oreva Egbeka, and thereby committed an offence punishable under Section 390(9) of the Criminal Code Law, Cap C21 Vol. 1, Laws of Delta State of Nigeria.”

“The case is called, the subjects are present.

“Inspector Juliet Obazee for the prosecution.

“The charge is read to the subjects in English language and they understood same and pleaded not guilty to the three-count charge.

“Order as follows:

“Court:

“The case is hereby transferred to the Family Court sitting at Ughelli Judicial Division. The parties are to appear before Your Worship Afornighe A. Edewor on the 23rd day of January 2026.”
