(AURN News) — Karmelo Anthony scored a major legal victory Wednesday, but his murder conviction still stands. A visiting judge assigned to consider the recusal request removed Judge John Roach from Anthony’s post-trial proceedings, finding that Roach’s conduct could cause a reasonable observer to question his impartiality.
Anthony, who is Black, was convicted of murdering 17-year-old Austin Metcalf, who is white, and sentenced to 35 years. His family and civil rights advocates have questioned a trial that seated no Black jurors, restricted public and media access and ended without Anthony testifying about his self-defense claim.
NAACP President Derrick Johnson said “qualified Black people were not allowed to serve on the jury” and that other irregularities “could imply bias” in the case. He said the concerns fit a broader pattern that has caused many Black Americans to question whether the justice system treats them fairly.
The successful recusal motion focused on Roach publicly defending the verdict and his rulings after sentencing while other parties remained under a gag order.
A new judge will now hear Anthony’s motion for a new trial.
