GUYANA-Court awards multi-million dollar compensation to a youth who was unlawfully arrested.

GEORGETOWN, Guyana, CMC – A High Court judge has awarded a 25-year-old man, who was wrongfully arrested, detained, imprisoned, and maliciously prosecuted by the Guyana Police Force (GPF) in 2023, eight million dollars (One Guyana dollar = 0.004 cents) in compensation.

Terrence Sandy filed a lawsuit against the GPF in 2024 over the 2023 incident, and Justice Sherdel Issacs-Marcus ruled that he was wrongfully arrested, wrongfully imprisoned for a total of 80 days by agents/officers of the State, and was subjected to inhumane and degrading treatment by agents of the State.

The Court also declared that his fundamental rights, as guaranteed under the Guyana Constitution, had been violated by the State, which maliciously prosecuted him by GPF members without seeking legal advice on the matter.

The Court was told that Sandy was on his way home in his village of Kuru Kururu on June 10, 2023, when he was placed in a police vehicle, taken to a police station, and held for hours without being asked any questions or told of any complaint against him.

Eventually, he was taken to Court and charged with breaking, and he refused bail.

But the matter was withdrawn after his attorneys, Dexter Todd and Dexter Smartt, realized there were several violations and that there was no accusation or evidence against him.

The attorneys said the High Court ruling in the case reflects its zero tolerance for Constitutional breaches against citizens.
